Agreement to Terms

By accessing or using PromptPilot ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

Description of Service

PromptPilot is an AI-powered platform that helps users optimize prompts for various AI models, test prompts across multiple models, generate AI images, and manage their prompt library. The Service includes:

• AI prompt optimization using advanced language models
• Multi-model testing and comparison across AI platforms
• AI image generation
• AI content generation and organization (Library)
• Analytics and usage tracking
• Chrome Extension for browser integration

Service evolution

PromptPilot is an actively evolving service. This means:

• Features may change, be added, or removed without notice
• Service availability is not guaranteed
• Bugs and issues may occur
• Pricing and subscription tiers may change
• We welcome feedback and suggestions for improvement

By using the Service during beta, you acknowledge these limitations and agree to provide constructive feedback.

Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of unauthorized access
• Be responsible for all activity under your account
• Not share your account with others

You must be at least 13 years old to create an account.

Acceptable Use

You agree not to use the Service to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Generate, store, or distribute harmful, illegal, or offensive content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use automated systems to access the Service without permission
• Resell or redistribute the Service
• Reverse engineer or attempt to extract source code

Content and Intellectual Property

Your Content

You retain ownership of prompts and content you create ("Your Content"). By using the Service, you grant us a limited license to:

• Store and process Your Content to provide the Service
• Use Your Content to improve our AI optimization features (anonymized and aggregated)
• Display Your Content back to you in the Service

Our Content

The Service, including all software, designs, and trademarks, is owned by PromptPilot and protected by intellectual property laws. You may not copy, modify, or create derivative works without permission.

Subscription and Payments

Free Tier

We offer a free tier with hourly and weekly action limits across Text Studio, Image Studio, and Voice. Free tier users receive 30 actions per hour and 300 per week, plus 3 standard images per day. Limits reset on a rolling window — no monthly cliff.

Paid Subscriptions

Paid subscriptions raise your hourly and weekly action limits. By subscribing:

• You authorize recurring charges to your payment method
• Subscriptions auto-renew unless canceled
• You can cancel anytime; cancellation takes effect at end of billing period
• Refunds are handled on a case-by-case basis
• We reserve the right to change pricing with 30 days' notice

Action Limits

Every AI request — prompt optimization, chat, image generation, voice dictation, MCP and Chrome extension calls — counts as one action against your hourly and weekly limits. Tier configuration and the per-tier allowance is published on our pricing page.

• Limits reset on a rolling window: each action ages out of the hourly window after one hour, and the weekly window after seven days
• No top-ups — to access more headroom, upgrade your tier
• Premium models consume slightly more of your allowance per call than cheaper models
• Action limits cannot be transferred between accounts

Third-Party Services

Our Service integrates with third-party AI providers to power prompt optimization and image generation features. Your use of these integrations is subject to the respective terms of service of each provider. We are not responsible for:

• Availability or performance of third-party services
• Content generated by AI models
• Changes to third-party pricing or features
• AI-generated images that may not match your expectations

AI-Generated Content

Content generated or optimized by AI, including text prompts and images, may:

• Contain inaccuracies or errors
• Not be suitable for all purposes
• Require human review and editing
• Be similar to content generated for other users
• Be subject to content policy restrictions by underlying AI providers

You are responsible for reviewing and validating AI-generated content before use. We make no warranties about the accuracy, quality, or suitability of AI outputs. AI-generated images are stored temporarily and may be subject to automatic deletion based on our retention policies.

Privacy and Data

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our data practices as described in the Privacy Policy.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The Service is free of viruses or harmful components
• Results from use will be accurate or reliable

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROMPTPILOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

Indemnification

You agree to indemnify and hold harmless PromptPilot from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of others
• Your Content

Termination

We may suspend or terminate your access to the Service at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• At our discretion with or without cause

Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our retention policies.

Changes to Terms

We may modify these Terms at any time. Material changes will be notified via:

• Email to your registered address
• Prominent notice in the Service
• Update to the "Last Updated" date

Continued use after changes constitutes acceptance of the new Terms. If you disagree, you must stop using the Service.

Governing Law and Disputes

These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes shall be resolved through:

• Good faith negotiation
• Binding arbitration if negotiation fails
• Small claims court for qualifying disputes

Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PromptPilot.

Severability

If any provision is found invalid or unenforceable, the remaining provisions remain in effect.

No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

Assignment

You may not assign these Terms without our consent. We may assign these Terms without restriction.
